Statehouse — State Sen. Jean Leising (R-Oldenburg) will serve as co-chair of the Drainage Working Group for the 2023 legislative session.
The working group was created by Act of registration in the Senate 85drafted by Leising, during the 2022 legislative session to study the regulatory issues of agricultural land drainage.
The working group:
- Review the responsibilities of landowners and state and local authorities under applicable laws relating to land drainage;
- Make decisions and recommendations regarding drainage and regulatory matters;
- To determine whether the balance between state and local authority over agricultural land drainage favors state authority more in Indiana than in neighboring states; and
- Issue an electronic report providing legislative recommendations by December 1, 2023 to the Executive Director of the Legislative Services Agency for distribution to the General assembly and governor.
“I’ve heard from many constituents in my district and across the state who are expressing unrelenting concern about current land drainage laws,” Leising said. “As chairman of the Senate Agriculture Committee and author of SEA 85, I look forward to continuing the discussion of the needs and issues relating to this topic and to reviewing state and local authorities regarding drainage laws.
The task force will be made up of 19 members, including six members of the Indiana Senate, six members of the Indiana House of Representatives and seven governor appointees.
Governor appointees will include an employee of the Department of Environmental Managementan employee of the Ministry of Natural Resourcesmember of a county drainage board, member of the governing body of a soil and water conservation district, representative of the Indiana Chapter of the American Society of Farm Managers and Rural Appraisersa representative of a statewide agricultural organization and a county surveyor.
